Frequently Asked Questions

Does Missouri have a False Claims Act (FCA)?

Yes. Missouri has a state False Claims Act that only applies to the state Medicaid program.

Does the Missouri FCA have a whistleblower provision?

No. The original source of the information, in a successful case, can receive 10 percent of the recoveries, but there is no specific provision for whistleblowers who bring a private action on behalf of the state. If the original source had any involvement in the fraud, they receive no award.

Does Missouri recognize the public policy exception for wrongful termination?

Yes. Missouri recognizes that an employer may not terminate an at-will employee where the termination would violate a clear mandate of public policy.
